By posting mp3s users indemnify Overtone against any claims whatsoever resulting from the use of these mp3s by any third party. Those who post mp3s on overtone do so with the express agreement of their record labels and management and are entirely responsible for their actions with regard to these mp3s.
• Overtone does not necessarily monitor all mp3s posted on the site and is therefore is not responsible for their content or condition. Users who listen to these mp3s do so at their own risk.
• Be advised that if you voluntarily disclose any of your own personal information (your name, e-mail address, etc.) that this information can be collected and used by others and may result in unsolicited messages from other parties.
• Do not post anyone else's private contact details. These include but are not limited to the following: real name, workplace, phone number, home address or e-mail address. Overtone encourages users to take screenshots of our site for use in print and online publications. These terms of use are not without legal force against you. Thus, when you submit information, purchase a ticket or conclude any other transaction via this web site, you are entering into a legally binding and enforceable agreement with us. Further, when you utilize the services offered by us on this site, you are acknowledging that you have read, understood and accept these terms of use.
We may change any of these terms from time to time. Therefore, you should keep up-to-date with their content and read these terms of use at all times prior to using this site since the then current version of the terms will apply to your use. By utilizing any of the services offered on this site, including by purchasing any ticket or concluding any other transaction, you indicate that you have done so.
You acknowledge that content submitted to this web site by other users do not represent our views and that we have not authorized nor endorsed such content. You agree not to post or transfer to our web site (nor include in any message sent to our web site) any material that is unlawful or violates any third party rights or which is obscene, misleading, inaccurate, defamatory, illegal, in breach of any copyright or other intellectual property right, or damaging to data, software or the performance of our or any other parties computer system. You agree to indemnify us in respect of any liabilities, losses, expenses, or other costs whatsoever incurred as a result of a breach of your obligation hereunder, including, but not limited to, any claims made against us by any third party.
Breach
In the event of either party breaching any of its obligations under this Agreement and failing to remedy such breach within a period of 10 (ten) working days of receipt of a written notice from the other party requiring it to do so, then the other party shall be entitled, without prejudice to any other right which it may have in law, to cancel this Agreement or to claim specific performance and to claim proven damages in respect of such breach.. The Company may withhold all monies from the Client until such breach is resolved.
Disputes
This Agreement shall be governed, interpreted and implemented in accordance with the laws of the Republic of South Africa.
Terms and Conditions of Overtone Ticketing for the user
The user is defined as a registered member using the Overtone Ticketing platform to buy tickets, vouchers, music or make donations.
Tickets are defined as virtual tickets bought either online through the overtone ticketing system, through mobile or other accredited resellers. A Product is defined as a non shippable virtual product that can either be downloaded or redeemed from the seller.
The event / product is charged at the sellers price minus the determined processing free. For example: If the ticket costs R50 at the door, Overtone Online Ticketing charges the user R40 and a R10 processing fee. The purchase of multiple tickets on the system will still result in a once off processing fee being charged per order being made.
Overtone will not be held liable for the loss of tickets, incorrect orders, uncompleted payments, or any matters that may result prior to and at the given event.
In the event of the cancellation of events the following rules apply:
In order to claim a refund on the ticket where the event has been cancelled it is up to the user to inform Overtone about the status of the event. If the claim is validated and made within 7 days of the event date the user will receive a refund.
A refund will be calculated as the Event ticket price. This payment will be made in Overtone Credits. Cash refunds are not accepted.
Once your Overtone Credits reach 500 you may at your own discression request payment out. Depending on the medium in which you wish you be paid, Overtone will them deduct the appropriate banking fees calculates as >>>>>>>>>>>>>>>>
You have a window of 7 days to claim a legitimate refund. After this the Promoter will be paid all monies owing to him and any further discussion will have to be taken up with the Seller / Promoter directly.
A legitimate refund is defined as a cancelled event that has been validated by the promoter or venue and minimum number of users.
Feedback of a cancelled event can be made via online comments or emails addressed to admin@overtone.co.za
Should the event have taken place but you wish to require a refund due to personal reasons, this will be subject to approval from the seller/ promoter and their terms and conditions. These requests need to be taken up directly with the promoter. Overtone will not be held accountable for processing these kinds of requests.
Overtone credit is defined as a virtual online currency through which Overtone tickets and products may be bought. 1 Overtone credit is currently defined as 1 overtone rand, however any payments made with overtone credits are subject to fluctuation.
Overtone credits can be earned via the Affiliate Scheme or through online sales and donations.
Overtone charges a processing fee for all payments made with Overtone credits. This is set at R2 per transaction / order. The same applies when drawing credits out the system. In the event of drawing credits out the system the user will also be charged banking fees.
Overtone Credits can only be bulk purchased via EFT payment.
Payments may also be made via Paypal. FNB online banking uses can create a Paypal Account without the use of a credit card by simply connecting their account with Paypal. All payments made via Paypal are calculated at exchange rates. Please use the currency converter found at the bottom of the website.
The Affiliate Scheme is open to all Overtone users. This is a viral marketing platform that earns you overtone credits by inviting unregistered friends to register on the system through the use of a unique affiliate code.
Existing users cannot be affiliated to more then one account. The Affiliate scheme lasts for 1 year. Thereafter
Users can earn R1 worth of Overtone credit from each purchase that their affiliates make through the system. Affiliate points are only paid out in Overtone credits and are updated at midnight.
The user is responsible for the management of their own account and all related transactions. Overtone cannot be held responsible for the loss of users’ accounts details, or errors made on the system by the users including the mismanagement of payments.
The miss use of your account can result in your account being deleted. Any credits remaining in the system may be forfeited at the discretion of Overtone.
The user is responsible for all vouchers and discounts claimed via Overtone. The user will also need to accept the suppliers’ terms and conditions which will be posted with the product. Vouchers and coupons are subject to availability / while stocks last. Overtone cannot be held accountable for lack of availability / limited stock. Issues arsing from the processing and claiming of said vouchers is under the discretion of the Supplier. Should a voucher be no longer valid please contact Overtone.
Tickets can only be used in a validated event. The user may be asked to produce other Identification other then the ticket printout. Should the user not be able to confirm Identification it is under the discretion of the promoter to allow or deny access.
Wrongful Tickets bought to events where the user does not comply with the restrictions/ terms and conditions cannot be claimed from the ticketing company. Eg an U18 purchases a ticket for an +18 event and is denied access at the door.
Ticket purchases can be made online, facebook, mobile, or at selected outlets.
Overtone cannot be held accountable for the loss of tickets. The user can log in to their overtone account and reprint the latest tickets online. Overtone users need to print their tickets and bring them to the door in order to gain entry.
Uncompleted processing or pending tickets are invalid until confirmed. Users will then be charged the door fee, subject to availability, and the discretion of the promoter.
Proof of payment needs to be faxed to 0865673202. Only once the monies owing have cleared will your ticket / purchase be confirmed. EFT delays between banks to Standard Bank are under the discretion of the user.
The promoter may have additional terms and conditions specific to their event / purchase. The user needs to take these into consideration and accept all related terms and conditions. Overtone cannot be held accountable for users who breach these terms and conditions.
Promoters may reserve the right to deny access to the event, evict the user for misuse or damages caused at the event. Overtone cannot be held accountable the promoters final ruling.
Processing Fees – Processing fees can be found at the bottom of the website.
Payments for tickets are declared validate once they have cleared. ie. once we recieve pop or echeque notification then we set the order as completed.. but if the cash does not arrive then we deduct it from the promoters ballance. The same application applies to credit card payments. Should the payment be revoked within 6 months of the event date Overtone will deduct this from the promoters account.
Registered Charities that meet our criteria may apply to crowd source donations for special projects. Applications are done directly to Overtone Administration. The charities are only charges processing fees / banking fees. Overtone does not take a commission or admin fee off of any charitable donations.
However a Chartable product, just like any other product on the site is charged a bandwidth fee. This applies to screensavers, mp3’s and other digital products.
Overtone Charges are 1.20 per downloadable track
All purchase and refund policies are at the discretion of the event promoter / venue that’s ticket are on sale. Each promoter / venue has their own policies and we will enforce these upon their request.
The Seller / Promoter is responsible for all marketing and promotions of ticket sales via social networks and commercial mediums. The Promoters is also responsible that any media sent out regarding ticket sales meets with Overtone requirements.
The Seller / Promoter is responsible for all the data they upload onto the ticketing system. Overtone cannot be held accountable for any errors made by the seller / promoter.
By selling tickets on Overtone, the seller / promoter accepts these mentioned terms and conditions.

Thus, when you submit information, purchase a ticket or conclude any other transaction via this web site, you are entering into a legally binding and enforceable agreement with us. Further, when you utilize the services offered by us on this site, you are acknowledging that you have read, understood and accept these terms of use.
We may change any of these terms from time to time. Therefore, you should keep up-to-date with their content and read these terms of use at all times prior to using this site since the then current version of the terms will apply to your use. By utilizing any of the services offered on this site, including by purchasing any ticket or concluding any other transaction, you indicate that you have done so.
You acknowledge that content submitted to this web site by other users do not represent our views and that we have not authorized nor endorsed such content. You agree not to post or transfer to our web site (nor include in any message sent to our web site) any material that is unlawful or violates any third party rights or which is obscene, misleading, inaccurate, defamatory, illegal, in breach of any copyright or other intellectual property right, or damaging to data, software or the performance of our or any other parties computer system. You agree to indemnify us in respect of any liabilities, losses, expenses, or other costs whatsoever incurred as a result of a breach of your obligation hereunder, including, but not limited to, any claims made against us by any third party.
Breach
In the event of either party breaching any of its obligations under this Agreement and failing to remedy such breach within a period of 10 (ten) working days of receipt of a written notice from the other party requiring it to do so, then the other party shall be entitled, without prejudice to any other right which it may have in law, to cancel this Agreement or to claim specific performance and to claim proven damages in respect of such breach.. The Company may withhold all monies from the Client until such breach is resolved.
Disputes
This Agreement shall be governed, interpreted and implemented in accordance with the laws of the Republic of South Africa.
Terms and Conditions of Overtone Ticketing for the user
The user is defined as a registered member using the Overtone Ticketing platform to buy tickets, vouchers, music or make donations.
Tickets are defined as virtual tickets bought either online through the overtone ticketing system, through mobile or other accredited resellers. A Product is defined as a non shippable virtual product that can either be downloaded or redeemed from the seller.
The event / product is charged at the sellers price minus the determined processing free. For example: If the ticket costs R50 at the door, Overtone Online Ticketing charges the user R40 and a R10 processing fee. The purchase of multiple tickets on the system will still result in a once off processing fee being charged per order being made.
Overtone will not be held liable for the loss of tickets, incorrect orders, uncompleted payments, or any matters that may result prior to and at the given event.
In the event of the cancellation of events the following rules apply:
In order to claim a refund on the ticket where the event has been cancelled it is up to the user to inform Overtone about the status of the event. If the claim is validated and made within 7 days of the event date the user will receive a refund.
A refund will be calculated as the Event ticket price. This payment will be made in Overtone Credits. Cash refunds are not accepted.
Once your Overtone Credits reach 500 you may at your own discression request payment out. Depending on the medium in which you wish you be paid, Overtone will them deduct the appropriate banking fees calculates as >>>>>>>>>>>>>>>>
You have a window of 7 days to claim a legitimate refund. After this the Promoter will be paid all monies owing to him and any further discussion will have to be taken up with the Seller / Promoter directly.
A legitimate refund is defined as a cancelled event that has been validated by the promoter or venue and minimum number of users.
Feedback of a cancelled event can be made via online comments or emails addressed to admin@overtone.co.za
Should the event have taken place but you wish to require a refund due to personal reasons, this will be subject to approval from the seller/ promoter and their terms and conditions. These requests need to be taken up directly with the promoter. Overtone will not be held accountable for processing these kinds of requests.
Overtone credit is defined as a virtual online currency through which Overtone tickets and products may be bought. 1 Overtone credit is currently defined as 1 overtone rand, however any payments made with overtone credits are subject to fluctuation.
Overtone credits can be earned via the Affiliate Scheme or through online sales and donations.
Overtone charges a processing fee for all payments made with Overtone credits. This is set at R2 per transaction / order. The same applies when drawing credits out the system. In the event of drawing credits out the system the user will also be charged banking fees.
Overtone Credits can only be bulk purchased via EFT payment.
Payments may also be made via Paypal. FNB online banking uses can create a Paypal Account without the use of a credit card by simply connecting their account with Paypal. All payments made via Paypal are calculated at exchange rates. Please use the currency converter found at the bottom of the website.
The Affiliate Scheme is open to all Overtone users. This is a viral marketing platform that earns you overtone credits by inviting unregistered friends to register on the system through the use of a unique affiliate code.
Existing users cannot be affiliated to more then one account. The Affiliate scheme lasts for 1 year. Thereafter
Users can earn R1 worth of Overtone credit from each purchase that their affiliates make through the system. Affiliate points are only paid out in Overtone credits and are updated at midnight.
The user is responsible for the management of their own account and all related transactions. Overtone cannot be held responsible for the loss of users’ accounts details, or errors made on the system by the users including the mismanagement of payments.
The miss use of your account can result in your account being deleted. Any credits remaining in the system may be forfeited at the discretion of Overtone.
The user is responsible for all vouchers and discounts claimed via Overtone. The user will also need to accept the suppliers’ terms and conditions which will be posted with the product. Vouchers and coupons are subject to availability / while stocks last. Overtone cannot be held accountable for lack of availability / limited stock. Issues arsing from the processing and claiming of said vouchers is under the discretion of the Supplier. Should a voucher be no longer valid please contact Overtone.
Tickets can only be used in a validated event. The user may be asked to produce other Identification other then the ticket printout. Should the user not be able to confirm Identification it is under the discretion of the promoter to allow or deny access.
Wrongful Tickets bought to events where the user does not comply with the restrictions/ terms and conditions cannot be claimed from the ticketing company. Eg an U18 purchases a ticket for an +18 event and is denied access at the door.
Ticket purchases can be made online, facebook, mobile, or at selected outlets.
Overtone cannot be held accountable for the loss of tickets. The user can log in to their overtone account and reprint the latest tickets online. Overtone users need to print their tickets and bring them to the door in order to gain entry.
Uncompleted processing or pending tickets are invalid until confirmed. Users will then be charged the door fee, subject to availability, and the discretion of the promoter.
Proof of payment needs to be faxed to 0865673202. Only once the monies owing have cleared will your ticket / purchase be confirmed. EFT delays between banks to Standard Bank are under the discretion of the user.
The promoter may have additional terms and conditions specific to their event / purchase. The user needs to take these into consideration and accept all related terms and conditions. Overtone cannot be held accountable for users who breach these terms and conditions.
Promoters may reserve the right to deny access to the event, evict the user for misuse or damages caused at the event. Overtone cannot be held accountable the promoters final ruling.
Processing Fees – Processing fees can be found at the bottom of the website.
Payments for tickets are declared validate once they have cleared. ie. once we recieve pop or echeque notification then we set the order as completed.. but if the cash does not arrive then we deduct it from the promoters ballance. The same application applies to credit card payments. Should the payment be revoked within 6 months of the event date Overtone will deduct this from the promoters account.
Registered Charities that meet our criteria may apply to crowd source donations for special projects. Applications are done directly to Overtone Administration. The charities are only charges processing fees / banking fees. Overtone does not take a commission or admin fee off of any charitable donations.
However a Chartable product, just like any other product on the site is charged a bandwidth fee. This applies to screensavers, mp3’s and other digital products.
Overtone Charges are 1.20 per downloadable track
All purchase and refund policies are at the discretion of the event promoter / venue that’s ticket are on sale. Each promoter / venue has their own policies and we will enforce these upon their request.
The Seller / Promoter is responsible for all marketing and promotions of ticket sales via social networks and commercial mediums. The Promoters is also responsible that any media sent out regarding ticket sales meets with Overtone requirements.
The Seller / Promoter is responsible for all the data they upload onto the ticketing system. Overtone cannot be held accountable for any errors made by the seller / promoter.
By selling tickets on Overtone, the seller / promoter accepts these mentioned terms and conditions.

Overtone asks its members and users for their personal details to subscribe for specific information, or entering various applications electronically. This data is only held for the specified purpose and is never shared with any third party organizations except where Overtone integrates with other social networking applications or modules that improve the general functioning of the Overtone website and service.
